The following Fatawa are selected from responses given by some of the famous scholars in the Muslim world today. Some of the questions were responded to by the "Standing committee" made up of eminent scholars.


The One Who does not Have a " Male Relative" is Not
Obliged to Perform Hajj.

Question: A woman well-known for her piety, in her middle ages or close to being elderly, wants to make the Hajj of Islam. However, she does not have a mohram. From the same country there is a man who is well-known for his piety who wants to make Hajj and he is traveling with women whom he is related to. Is it proper for that woman to make Hajj with this man and the women he is traveling with, being among the women and the man is watching over them? Does she have to perform the Hajj or is this requirement dropped from her since she does not have a mohram, even though she is financially capable? Give us a response, may Allah reward you.

Response: The woman who does not have a mohram is not obliged to perform Hajj. This is because a mohram, with respect to her, is part of the necessary aspects to having the means to perform the Hajj. Having the means is one of the conditions for the obligatory nature of Hajj. Allah says: "And Hajj to the House is a duty that mankind owes to Allah, those who can afford the expenses." (Al-Imran 97)

It is not allowed for her to travel for Hajj or otherwise without her husband or a mohram. This is based on what al-Bukhari recorded that the Prophet (peace be upon him) said: "It is not allowed for a woman to travel a day and night's distance except with a mohram." Al-Bukhari and Muslim also recorded from ibn Abbas that he heard the Prophet (peace be upon him) say: "A man can not be alone with a woman unless in the presence of a mohram of hers. And a woman does not travel except along with a mohram." A man said, "O Messenger of Allah (pease be upon him), my wife has left to make Hajj and I have enlisted for such and such expedition." He said: "Go and make Hajj with your wife."

Using Pills that Stop the Menses in Order to Perform Hajj.

Question: Is it allowed for women to use such pills that prevent or delay her menses during the time of Hajj?  

Response: It is allowed for a woman to use pills that prevent the menses during the time of Hajj out of fear that her menses will come. That must be done only after she consults a specialist doctor who has her safety and interest in mind. The same is true with respect to Ramadhan if she wishes to fast with the people.

Women Enter the Ihram in any Clothing They Wish.

Question: Is it allowed for a woman to enter the state of Ihram in any clothing she wishes?

Response: Yes, she may enter the ihram in whatever clothing she wishes. She does not have any specific type of clothing that she must wear for ihram as many of the general public think. But it is better for her to enter the ihram in clothing which is not beautiful and will not attract the one who sees it. This is because she is going to be mixing with men, so her clothing must not be such that it tempts the looker. It should not be beautiful but should be customary and not a temptation.

Ruling Concerning Changing the Clothing of Ihram.

Question: Can a person change the clothing of ihram in order to wash them?

Response: There is no harm in washing the clothes during the ihram. There is no harm in exchanging them for others and putting on a new or washed clothing.

The Ruling of the "Farewell Tawaf" for the One Performing Umra and Purchasing Something After that Tawaf.

Question: Is the "Farewell Circumambulation of the Kaaba (Tawaf)" obligatory for the one making Umra? Is it allowed to purchase something in Makkah after making the "Farewell Circumambulation," regardless of whether that was for the Hajj or Umrah?

Response: The "Farewell Circumambulation" is not obligatory for the Umra. However, it is best to do so. If, though, someone leaves and did not perform it, then there is no harm. However, for the Hajj, it is obligatory, because the Prophet (peace be upon him) said: "None of you should leave until he performs the last circumambulation around the house." These words were directed to the pilgrims.

The person may purchase whatever he needs to purchase afterwards. He may even purchase items for business purposes. But the time interval must be short. If he spends a lengthy time [in Makkah after performing farewell circumambulation], he must then repeat his circumambulation. If according to custom, his stay afterwards was not lengthy, he does not repeat the circumambulation in any case.

Standing Outside the Boundaries of Arafa.

Question: If the pilgrim performs Hajj stood outside the boundaries of Arafa -close to it- until the sun sets then he left. What is the Islamic ruling in this case?

Response: If the pilgrim did not stand in Arafa at the prescribed standing time, then he has not performed Hajj. This is because the Prophet (peace be upon him) said:

"Hajj is Arafa." So, whoever reaches Arafa at nighttime before dawn, then he has performed Hajj. The prescribed standing time is the period after Zawal of the day of Arafa until dawn [i.e. end of nighttime before day of slaughtering (Nahr)] This is what the scholars have agreed upon. However, the scholars have different opinions about standing in Arafa before Zawal. The majority of them say that it is not sufficient to stand before Zawal without standing after Zawal or at nighttime. But whoever stands at daytime after Zawal or at nighttime, then that will be sufficient. However, it is better to stand at daytime after praying Zuhr and Asr combined (at Zuhr time) until sunset. It is not permissible for those who stood at daytime (after Zawal) to leave before sunset, and whomever does that, has to slaughter a sheep because he has omitted combining standing at daytime and nighttime (which is obligatory on those who stood at daytime after Zawal.)

Spending the Night Outside Mina.

Question: If the pilgrim could not find a place to spend the night in Mina, what should he do? And if he spends the night outside Mina, does he need to do something to make up for that?

Response: If the pilgrim does his best in looking for a place to spend the night in Mina, but he was not successful, then there is no harm if he stays outside Mina. This is because Allah says: "

He does not need to make up for that because it was beyond his capability.
